1. Agreement to Terms

By accessing and using HausScout ("Service", "we", "our", or "us"), you accept and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use the Service.

2. Service Description

HausScout provides apartment hunting concierge services in Frankfurt, Germany, including:

  • Creating and managing accounts on apartment platforms (WG-Gesucht, Immowelt, eBay Kleinanzeigen, etc.)
  • Contacting landlords and potential co-tenants on your behalf
  • Scheduling apartment viewings
  • Providing progress updates through your dashboard

Important: This is a human-powered concierge service. We act as your authorized representative in apartment hunting activities. We do not guarantee apartment availability or successful applications.

3. Eligibility

To use our Service, you must:

  • Be at least 18 years of age
  • Have legal capacity to enter into binding contracts
  • Be seeking housing in Frankfurt, Germany
  • Provide accurate and truthful information
  • Comply with all applicable laws and regulations

4. Account Registration & Authorization

4.1 Account Creation

You must create an account to use our Service. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access

4.2 Power of Attorney & Authorization

By using our Service, you grant HausScout limited power of attorney to:

  • Create accounts in your name on apartment search platforms
  • Send messages to landlords and co-tenants on your behalf
  • Schedule viewings in your name
  • Access and manage your credentials for third-party platforms

Limitations: We will NOT sign contracts, transfer money, or make binding commitments on your behalf without explicit written consent.

4.3 Consent & E-Signature

You must provide electronic signature consent before we begin services. This consent includes authorization to act on your behalf for apartment hunting purposes within the scope defined above.

5. Subscription & Payment Terms

5.1 Pricing

  • Standard Plan: €30/month - We manage your accounts and contact landlords/co-tenants
  • Premium Plan: €60/month - Includes premium platform accounts (if you don't already have them)

5.2 Billing

  • Subscriptions are billed monthly in advance
  • All payments are processed securely through Stripe
  • Prices are in Euros (€) and include German VAT (Mehrwertsteuer) where applicable

5.3 Free Trial

New users receive a 15-day free trial. You will not be charged during the trial period. After the trial ends, your subscription will automatically renew unless cancelled.

5.4 Cancellation

  • You may cancel your subscription at any time from your account dashboard
  • Cancellation takes effect at the end of your current billing period
  • No refunds for partial months unless required by law

5.5 Refund Policy (14-Day Right of Withdrawal)

In accordance with German and EU consumer protection law (Widerrufsrecht), you have the right to withdraw from this contract within 14 days without giving a reason.

The withdrawal period expires 14 days from the date of contract conclusion (subscription start). To exercise your right of withdrawal, contact us at support@hausscout.com with a clear statement of your decision to withdraw.

Consequence of Withdrawal: If you withdraw from this contract, we will reimburse all payments received from you within 14 days from the day we received your withdrawal notice.

Exception: If you expressly requested service to begin during the withdrawal period and we have fully performed the service, you forfeit the right of withdrawal.

6. User Responsibilities

You agree to:

  • Provide accurate personal and financial information for landlord applications
  • Respond promptly to viewing invitations and landlord communications
  • Review and approve messages before we send them to co-tenants (via WhatsApp)
  • Attend scheduled viewings or notify us in advance if unable to attend
  • Comply with all platform terms of service (WG-Gesucht, Immowelt, etc.)
  • Not misuse or abuse the Service
  • Not provide false or misleading information
  • Not use the Service for illegal purposes

7. Service Limitations & Disclaimers

7.1 No Guarantees

We do NOT guarantee:

  • Finding an apartment within a specific timeframe
  • Successful apartment applications
  • Response rates from landlords
  • Availability of specific apartments
  • Viewing invitations

7.2 Service Availability

We strive for continuous service availability but do not guarantee uninterrupted access. We may suspend or terminate service for maintenance, security, or technical reasons with reasonable notice when possible.

7.3 Third-Party Platforms

We are not affiliated with WG-Gesucht, Immowelt, eBay Kleinanzeigen, Facebook, or other platforms. Changes to their terms, policies, or APIs may affect our ability to provide services.

8. Intellectual Property

All content, features, and functionality of the Service (including but not limited to text, graphics, logos, software) are owned by HausScout and protected by copyright, trademark, and other intellectual property laws.

You may not:

  • Copy, modify, or distribute Service content without written permission
  • Reverse engineer or attempt to extract source code
  • Remove copyright or proprietary notices
  • Use our trademarks without authorization

9. Data Protection & Privacy

We take your privacy seriously. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which complies with GDPR and German data protection laws.

Key points:

  • Your credentials are encrypted at rest
  • We only access third-party accounts when performing services
  • You can request data deletion at any time
  • We do not sell your personal data

10. Liability & Indemnification

10.1 Limitation of Liability

To the maximum extent permitted by German law:

  • We are liable without limitation for damages resulting from injury to life, body, or health caused by us or our legal representatives
  • We are liable without limitation for damages caused by intentional or grossly negligent conduct
  • For damages caused by slight negligence, we are only liable if we breach a material contractual obligation (cardinal duty). In such cases, liability is limited to foreseeable, typical damages
  • We are not liable for indirect, incidental, special, or consequential damages beyond these limitations

10.2 User Indemnification

You agree to indemnify and hold HausScout harmless from claims arising from:

  • Your violation of these Terms
  • Your violation of third-party rights
  • False information you provided
  • Your use of the Service for illegal purposes

11. Termination

11.1 Termination by User

You may terminate your account at any time through your account settings or by contacting support.

11.2 Termination by HausScout

We may suspend or terminate your access if:

  • You violate these Terms
  • You provide false information
  • Your payment fails repeatedly
  • You engage in abusive or fraudulent behavior
  • Required by law or regulatory authority

11.3 Effect of Termination

Upon termination:

  • Your access to the Service will cease immediately
  • We will stop acting on your behalf
  • Third-party platform accounts created by us will remain (you can manage them directly)
  • You may request data deletion (see Privacy Policy)

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

12.2 Jurisdiction

For merchants (Kaufleute), legal entities under public law, or special funds under public law, the exclusive jurisdiction is Frankfurt am Main, Germany.

For consumers within the EU, you may also bring legal action in your country of residence. We may only bring legal action against you in your country of residence.

12.3 EU Online Dispute Resolution

The European Commission provides an online dispute resolution platform at: https://ec.europa.eu/consumers/odr

13. Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance of new Terms.

If you do not agree to modified Terms, you may terminate your subscription before changes take effect and receive a pro-rated refund for unused service time.

14. Miscellaneous

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HausScout.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

14.3 No Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.

14.5 Language

These Terms are provided in English and German. In case of discrepancies, the German version shall prevail for users in Germany.

Consumer Rights Notice: As a consumer in Germany/EU, you have specific rights under consumer protection law, including the 14-day right of withdrawal described above. Nothing in these Terms limits your statutory consumer rights.
